D.C. Circuit Vacates Air Tour Management Plan Due to NEPA Concerns
D.C. Circuit vacated FAA and NPS Plan for air tour operations over California national parks due to NEPA concerns. Specifically, the D.C. Circuit found that CEQ did not have authority to issue binding regulations upon which the agencies relied in finding a categorical exclusion from the need to issue an environmental assessment or impact statement. Further, the decision to use the interim operations as a baseline was improper.
